Federal COBRA, NY and NJ State Continuation Guidance

For employers with 20 or more employees
Federal COBRA rules apply to employer groups with 20 or more employees that maintain group health plans.
|These employers are responsible for administering COBRA continuation coverage for their terminated employees.|
Administration can be done in-house or outsourced to a third party administrator (TPA).
For employers with fewer than 20 employees
COBRA does not apply to groups with fewer than 20 employees. Instead, the New York and New Jersey continuation of coverage program (or, mini-COBRA) applies to terminated employees of groups of under 20.
|Pursuant to Chapter 236 of the NY Laws of 2009, a person who is an employee or member of a group may continue group health insurance coverage for up to a total of 36 months regardless of the reason that the person lost eligibility for coverage.|
